Managing POPIA
Moonstone Business School of Excellence (MBSE) offers a comprehensive three-module online training course for executives or management to effectively govern the application of the Protection of Personal Information Act (POPIA) within their organisations.
The main objective of this course is to equip management with a comprehensive understanding of POPIA so that they can identify the changes that are needed in the organisation to be compliant with POPIA. Another objective is to outline the role, duties, and appointment process of the information officer to further ensure POPIA is applied and maintained throughout the organisation. Lastly, the course aims to raise awareness of the differences of applying POPIA and the GDPR which also includes the requirements for cross-border transfers and direct marketing under POPIA.
WHAT WILL THE COURSE ENABLE YOU TO DO?
After completing this course, you will have an understanding of:
- the purpose of POPIA;
- to whom POPIA applies and how it is enforced;
- personal and special information and how organisations should process information relating to children;
- rights of data subjects;
- who is accountable under POPIA;
- the data protection principles and the organisation’s responsibilities to ensure compliance with POPIA;
- the consequences of not complying with POPIA;
- the duties and responsibilities of the information officer and what must be considered when determining the appointment of the information officer;
- the powers and duties of the Information Regulator;
- the relevant foreign laws (such as the GDPR) and how to recognise the incidents when foreign law data protection principles are applicable to South African organisations; and
- POPIA’s requirements for cross-border transfers and direct marketing.

Executives and managers of organisations who must ensure the organisation is compliant with POPIA and/or who needs to appoint an Information Officer for the organisation.

CONTENT
Module 1 – Introduction to POPIA
This module provides an overview of the rationale and aims of POPIA. The module also analyses the application of POPIA and the rights of data subjects. Furthermore, the module provides an explanation on what is meant by personal and special personal information and who is accountable under POPIA. It concludes with the eight data protection principles of processing personal information under POPIA and how these principles can be applied in an organisation.
Module 2 – The role of the Information Officer and the powers of the Information Regulator
This module examines the role, duties, and capabilities required of the Information Officer to ensure compliance with POPIA as well as how to appoint and register an information officer for your organisation. The module further discusses the powers and duties of the Information Regulator.
Module 3 – International concerns and direct marketing
This module provides an overview of the important sections of the GDPR and their implications for South African organisations including the requirements for cross-border transfers and direct marketing under POPIA. The module concludes with a comparative overview of the important differences and similarities between POPIA and the GDPR.
ASSESSMENTS
Assessments are done online. Students have unlimited Self-Assessment attempts and two Final Assessment Attempts.

Students will receive a Digital Certificate of Completion once the Final Assessment has been successfully completed. A pass mark of 60% is required for the Final Assessment.

- National Credit Act
The National Credit Act No 34 of 2005 was passed by Parliament on the 10th of March 2006. It is designed to achieve a number of objectives, most of which are to benefit and protect the consumer. The aim is to introduce a single, functional system of regulation that will apply to all credit activities, thereby ensuring that all credit providers and credit consumers are treated equally.
- Getting to know FICA
The course will cover money laundering, terrorist financing and proliferation financing. It explains South Africa’s legislative framework to combat these financial crimes and penalties and administrative sanctions that can be imposed by the FIC. Theoretical knowledge of FICA for all staff members irrespective of whether they are a part of the transaction process within an accountable institution or not.
- Understanding FICA
The FICA Awareness Training is aimed at employees of accountable institutions and covers basic money-laundering and terrorist financing concepts, anti-money-laundering legislation in South Africa, the risk-based approach, and looks at the requirements for customer due diligence, reporting of certain transactions and record-keeping requirements.
- Managing FICA
This course is designed to assist FICA Compliance Officers and Money Laundering Reporting Officers of accountable institutions and reporting institutions in understanding the Financial Intelligence Centre Act 38 of 2001 (“FICA”) (and incidental legislation) at a greater depth.
- Getting to Know POPIA
